NOTICE OF ANIMAL SEIZURE
Minnesota Welfare Chapter 343 specifically authorizes authorities to investigate any alleged violation of the law relative to cruelty to animals. Minnesota Federated Humane Societies has such authority as written in the Minnesota Welfare Statute 343.01. It shall also be the duty of Minnesota Federated Humane Societies, it’s certified agents and other authorized authorities to take possession of any animal(s) in their respective jurisdiction, throughout the state of Minnesota, which have been cruelly treated and deliver the animal(s) to the proper offices for custody and care.
343.235 Subd. 3.a.2:
A person claiming an interest in the animal(s) may post security to prevent disposition of the animal(s) and may request a hearing concerning the seizure or impoundment. Failure to do so within (10) days of the date of the notice with result in disposition of the animal(s).
343.235 Subd. 3.a.3:
All actual costs of the care, keeping and disposal of the animal(s) are the responsibility of the person claiming an interest in the animal(s), except to the extent that a court of hearing officer finds that the seizure or impoundment was not substantially justified by law.
To prevent disposition, security sufficient to provide for the animal(s) care and keeping must be posted and a hearing requested. Costs for the care and keeping will be determined at the time of the seizure/intake of the animal(s). Costs could include, but may not be limited to: transportation, processing/intake fees, boarding fees and medical/veterinary/general care expenses.
In order to receive a hearing to contest the validity of the seizure, the owner or person claiming an interest in the animal(s) must notify their county court administration within (10) calendar days of the seizure date. Provide the following information to facilitate the judicial process;
